The June 4th, 2008 Legislative day was fun and informative !
NorBAR members and staff increased their political awareness by attending the annual C.A.R. Legislative Day at the Convention Center in downtown Sacramento.  Guided tours of the State Capitol Building, the REALTOR® showcase, and interviews with our representatives in State Government were just a few of the available activities.  Wow!  You've been told that C.A.R.  is huge, but it takes an event like this to truly grasp the magnitude of a 185,000 member association.  See you there next year!

Bill Cole Receives Sonoma County Spirit Award

Bill Cole was presented with the Sonoma County Spirit Award on November 29th, 2007!  The Spirit Award is an honor bestowed upon business leaders who contribute to the economic development and enhancement of the communities in which they live and work through donations of their time and experience.  Click here to see a picture of the presentation (Bill Cole is on your left in the picture).

Bill is a long-standing REALTOR® in Sonoma County.  He is currently on the NorBAR Board of Directors.  His community contributions are literally too numerous to list, but here are some highlights:

NorBAR Warns about using the Lake County Associaton of Realtors Disclosure Disclaimer Advisory
As you are aware, for some time NorBAR has had its legal counsel prepare and update a Disclosure Disclaimer Advisory for Lake County. The Lake County Association of REALTORS has recently created their own disclosure advisory form for Lake County. NorBAR’s legal counsel has reviewed the Lake County Association Disclosure Advisory and advises that “NorBAR Members should consult their own legal counsel before using the attached Lake County Association Form because to do so may be a breach of their fiduciary duty, may subject them to discipline by the D.R.E., and may be a violation of the N.A.R. Code of Ethics.” NorBAR’s legal counsel also has concerns regarding lack of clarity and substantive content of the form. For more specifics, please see the attached letter.

ALERT! ALERT!
An agent has been attacked in our area. This attack occurred around 3pm yesterday. The agent was the listing agent and received the call directly. The caller stated he and his wife were looking for a home and were from out of town and would like to see this house. The agent went to the listing to meet them. He arrived in a ski mask and brutally attacked her. The police have been contacted and are working on the case. They were able to trace the number he used from the agent’s cell phone; however, it was a pay phone. I can not stress how important it is for all of you to take appropriate safety precautions. Some safety tips: Meet clients at the office first. (A real buyer would not mind meeting you at the office then following you to the listing). Have your cell phone programmed for one touch local emergency numbers. (Often 911 calls go to a centralized bureau). Make sure someone knows where you are, when you will return and who you are with. Above all, if you have a strange feeling, DO NOT IGNORE IT. Please let me know if there are any other instances in our region as we can get the word out to the members. Gateways Redevelopment Project in Santa Rosa
The City is looking for individuals who might be interested in throwing their hat into the ring and running for a spot on the Project Area Committee. The Project Area Committee is a group of citizens who are residential owner-occupants, residential tenants, business owners (within the study area) or a member of a community organization that serves the Project Area. There will be a informational meeting to discuss the Redevelopment Plan, the establishment of the Project Area Committee on August 10th at 6p.m. Location: Santa Rosa Middle School Gymnasium.

Statewide Septic Rules – AB 885 Several years ago, legislation passed and was signed by the Governor that mandated the creation of Statewide Septic Rules. A hearing draft has been recently released for review. The impacts on property owners will be significant. NorBAR testifies before the Santa Rosa City Council regarding proposed changes to the Inclusionary Zoning Program.
The City of Santa Rosa is considering changing their approach to “For Sale” units generated by the Inclusionary Zoning program. NorBAR testified before the Council expressing our long standing concern for 30 year affordability restrictions on “For Sale” units that provide no ability for the homeowner to generate equity or to recoup money that they invest in the property. We do support the concept of a hybrid approach that provides a level of affordability for a number of years and then does provide an equity sharing approach that hopefully allows the homeowner to jump to the open market. The City Council will continue to look at different approaches to this issue in an upcoming Council Study Session.

NorBAR sends a letter asking the North Bay Congressional Delegation and California’s U.S. Senators to support additional funding for Highway 101.
NorBAR sent a letter to Congresswoman Woolsey, Congressman Thompson, Senator Boxer and Senator Feinstein asking for their support in securing $100 million dollars for Highway 101 through a new Projects of National and Regional Significance program. President Kim Pels indicated in the letter to our federal delegation that Highway 101 is a quality of life issue, an economic development issue and an air quality issue. We thanked our elected officials for their past support and asked for their help in securing the needed funding to fix the road!

Woodburning Appliance Ordinance deadlines in two Sonoma County communities.
Starting June 1, 2004, a Point of Sale inspection is required for free standing wood stoves and fireplace inserts in the City of Sebastopol (only inside the city limits). At press time, information is still not available regarding the inspection process. As soon as this information is available, the NorBAR Broker/Manager Community will be notified. Please call the NorBAR office if you have any questions. The City of Santa Rosa’s Ordinance includes a “Can’t Use” policy beginning June 1, 2004 for the older non-EPA certified free standing wood stoves and fireplace inserts. Neither of these requirements applies to open hearth fireplaces or pellet stoves. This information is included in the Sonoma County Disclosure Disclaimer Advisory.

CAR unveils 2004 Legislative Agenda.
At the January 2004 CAR Board Meetings, the Legislative Agenda for the year was unveiled. There are two bills that are carryover from 2003 – AB 578 (Leno), a bill that will allow a pilot program to test Electronic Recording and AB 920 (Nakano) a bill that “cleans up” language in existing statutes relating to transfer disclosures statements and disclosures of airport proximity. In addition to the carryover bills, CAR will be introducing the following bills:
  • Common Interest Development Disclosure – This bill will make several improvements in the rules governing sales and management of common interest development properties.
  • Condominium Conversion: Homeownership Opportunities for Tenants – CAR is co-sponsoring this bill with the Apartment Association of Greater Los Angeles which will provide statewide standards for condominium conversions in rent control jurisdictions.
  • Housing Element Reform – This bill would provide incentives for local governments who are contributing more housing than the surrounding cities and counties.
  • Making the Density Bonus Law Work – This bill will increase the flexibility and usefulness of the density bonus law by reducing by half the number of units that must be built in order for housing developers to receive a density bonus.
  • Ministerial Approval of Second Units – This bill will be the 2nd phase of AB 1866 (Wright) that passed in 2002. AB 1866 required local governments to make the 2nd unit process ministerial. Since the passage, some communities throughout the State of California have set up unreasonable guidelines as part of the ministerial process. This bill would prevent arbitrary restrictions that make it impossible to build a 2nd unit.

NorBAR sends a letter to the Santa Rosa City Council expressing concerns about the Draft Zoning Code.
NorBAR in conjunction with the Consulting Engineers and Land Surveyors of California, the Home Builders Association of Northern California, and the Santa Rosa Chamber of Commerce asked the City Council for additional time to continue discussing the Draft Zoning Code with the Planning Commission, staff and consultants. The Draft Zoning Code suggests significant changes which will impact how Santa Rosa looks for years to come. The City Council has allowed some additional meetings to take place and early indications are that these meeting will result in a much better Zoning Code.

NorBAR sponsors Candidate Events in Napa, Mendocino and Lake Counties.
NorBAR held Candidates Forums for Supervisorial Candidates throughout the NorBAR region in February. Napa REALTORS® had the opportunity to assess the Supervisorial Candidates for the 5th District – current Supervisor Mike Rippey and challenger Harold Moskowite, a former Napa County Supervisor. REALTORS in Lake County heard from Candidates for Supervisorial Districts 4 and 5 including current Supervisors Anthony Farrington and Rob Brown and challengers Cecil Brown, Lakeport Mayor Buzz Bruns, Janel Chapman and Harry Delope. Mendocino County REALTORS listened to Supervisorial Candidates from District 1 and District 2 including current Supervisors Michael Delbar and Richard Shoemaker and challengers Joe Louis Wildman, Irma Turner, Jim Wattenburger and Phil Baldwin. The forums were well attended and provided the provided a much appreciated opportunity to listen to the views of the various candidates.
